Court proceedings against Mukhtor Bokizoda was scheduled for 18 August

 

Radio Svoboda Bureau in Tajikistan reported that preliminary investigation had been finished in the criminal case #990 against the head of Kaikhon printing company and chief editor for Narui Sukhan, Mukhtor Bokizoda, and the case had been taken to the court. Safarali Kurbonov, Firdavsi District Court judge, said in his interview with the Radio Svoboda that the proceedings in the case were scheduled for 18 August, 2005.

The printing company that belonged to the Foundation for the Memory and Protection of
Journalists was accused of stealing electricity. The estimated damage was 1678 somoni 98
diram (over $500). However Bokizoda said to the monitoring reporter, that the criminal action is falsified to reach one goal – to stop him from resuming publishing Nerui Sikhan newspaper.

Mukhtor Bokizoda, head of the Foundation for the Memory and Protection of Journalists in Tajikistan, and his attorney Inoyat Inoyatov sent a motion to Safarali Kurbonov to stop the case proceedings. They said in the motion “unfortunately, the preliminary investigation bodies began investigating the case in a biased and “accusing” manner, in violation with article 15 of the Code of Criminal Procedure, resulting in the innocent person facing criminal charges that lack corpus delicti.”  In their motion, they also gave proofs of an indictment issued by Firdavsi Internal Affairs Department investigator against Bokizoda, being baseless. They believe Bokizoda’s actions lack elements of crime, and charges, that had been filed against him, fall under the category of “administrative civil offences.”

Following the situation, they sent the motion to close the criminal case.

It is worth mentioning that if Bokizova is found guilty of the crime, he will be sentenced to custodial restraint of up to 3 years and prison term of up to 4 years, as well as obligation not to hold certain offices or carry out certain activities for the period of up to 5 years or without.
